The purpose of this policy is to establish procedures and guidelines for employees and customers whose information may be collected during the act of providing a service or via Website engagement or use of our app, Oova.

This policy applies to Bitberry Pty Ltd (ACN 617 029 464) and related entities including but not limited to, Westview Group, Bestbar, and Unipod which will be referred to as “the Group” within this document.

The Group is committed to managing personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth) (Privacy Act) and in accordance with other applicable privacy laws.

3.1       We respect your privacy

The Group respects your right to privacy and is committed to safeguarding the privacy of our customers and website visitors. We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). This Policy sets out how we collect and treat your personal information.

“Personal information” is the information we hold which is identifiable as being about you.

3.2       Storage of personal information

Members of the Group will, from time to time, receive and store the personal information you enter onto our website, provided to us directly or given to us in other forms.

You may provide basic information such as your name, phone number, address and email address to enable us to send information, provide updates and process your product or service order. We may collect additional information at other times, including but not limited to, when you provide feedback, when you provide information about your personal or business affairs, change your content or email preference, respond to surveys and/or promotions, provide financial or credit card information, or communicate with our customer support.

Additionally, we may also collect any other information you provide while interacting with us.

Any personal information that is no longer needed for any purpose will be destroyed or de-identified.

The Group collects personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our website or Oova and when we provide our services to you. The Group utilises call tracking analytic software for quality assurance and training purposes. Recorded calls will have a notification announcement. We may receive personal information from third parties. If we do, we will protect it as set out in this Privacy Policy.

3.4       Use of your personal information

Members of the Group may use personal information collected from you to provide you with information, updates and our services. We may also make you aware of new and additional products, services and opportunities available to you. We may use your personal information to improve our products and services and better understand your needs.

Members of the Group may contact you by a variety of measures including, but not limited to telephone, email, SMS or mail.

The Group is committed to ensuring that the information you provide to us is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.

The transmission and exchange of information are carried out at your own risk. We cannot guarantee the security of any information that you transmit to us or receive from us. You may request details of personal information that we hold about you in accordance with the provisions of the Privacy Act 1988 (Cth). A small administrative fee may be payable for the provision of information. If you would like a copy of the information, which we hold about you or believe that any information we hold on you is inaccurate, out of date, incomplete, irrelevant or misleading, please email us at support@bitberry.com.au.

We reserve the right to refuse to provide you with information that we hold about you, in certain circumstances set out in the Privacy Act.

Please be aware that we may change this data collection and Privacy Policy in the future. We may modify this Policy at any time, in our sole discretion and all modifications will be effective immediately upon our posting of the modifications on our website or notice board.

SECTION 4 — WEBSITE AND MOBILE APP

The way in which we handle the personal information of visitors to our websites is discussed below.

When you come to our website (https://www.bitberry.com.au) or use our app Oova, which is our tracking and logistics application for iOS (Apple) and Android (Google) mobile devices, we may collect certain information such as browser type, operating system, website visited immediately before coming to our site, etc. This information is used in an aggregated manner to analyse how people use our site and our app, such that we can improve our service.

The Group collects personal information reasonably necessary to carry out our business, to assess and manage our client’s needs. We may also collect information to fulfill administrative functions associated with these services, for example billing, entering into contracts with you and/or third parties and managing client relationships.

The purpose for which the Group usually collects and uses personal information depends on the nature of your interaction with us, but may include:

  • Responding to requests for information and other general inquiries;
  • Managing, planning and administering website program to fulfill your order or enquiry;
  • Responding to enquiries or complaints;
  • Collection of location data for real-time delivery tracking and route optimization.

Most web browsers automatically accept cookies and by using our website and app you agree to such use of cookies unless you later decide to disable them. Please note that if you delete or disable our cookies this may prevent you from taking full advantage of our website or Oova.

Our website may from time to time use cookies to analyses website traffic and help us provide a better website visitor experience.

In addition, cookies may be used to serve relevant ads to website visitors through third party services such as Google Adwords. These ads may appear on this website or other websites you visit. Our site may from time to time have links to other websites not owned or controlled by us. These links are meant for your convenience only.

Links to third party websites do not constitute sponsorship or endorsement or approval of these websites.

Please be aware that the Group is not responsible for the privacy practices of other such websites. We encourage our users to be aware, when they leave our website, to read the privacy statements of each and every website that collects personally identifiable information.

5.2       Can you deal with the Group Anonymously?

The Group will provide individuals the opportunity of remaining anonymous or using a pseudonym in their dealings with us where it is lawful and practicable (for example when making a general enquiry). Generally, it is not practicable for the Group to deal with individuals anonymously on an ongoing basis. If we do not collect personal information about you, you may be unable to utilise our services we manage or deliver.

5.3       Does the Group use or disclose your personal information for direct marketing?

Members of the Group may use or disclose your personal information for the purpose of informing you about services or other opportunities that may interest you. If you do not want to receive direct marketing communications, you can opt out any time by contacting support@bitberry.com.au

If you opt out of receiving marketing material from us, members of the Group may still contact you in relation to its ongoing relationship with you.

5.4       Location data

When you use our services we may collect information about your location. With your permission we may also collect information about your precise location using methods that include GPS, wireless networks, cell towers, Wi-Fi access points and other sensors.

We only use location related information to provide and personalise our product and services and any information collected is for the specific purpose of the services provided through the Group members website or Oova.

The collection of location data is necessary to implement core features of Oova, including real-time delivery tracking and route optimization. The location data collected is only used for the purposes that you have consented to within Oova. Your location data that is collected while using Oova is stored on our servers, and may be stored on the servers of our clients who license our software. The location data is made available to other members of the delivery team via our web applications to facilitate the delivery tracking process.

Any location data collected is not distributed to unrelated third parties, sold or used to support advertising.

You can, at any time, request a review or deletion of any of your past location data by contacting us via support@bitberry.com.au.

SECTION 6 — DISCLOSURE OF PERSONAL INFORMATION

6.1       For clients and customers

The purposes for which we may use and disclose your personal information will depend on the services we are providing you. For example, if you have engaged us to deliver a service or product, we may disclose information about you to the service providers where this is relevant to our services.

6.2       Disclosure to contractors and other service providers

The Group may disclose information to third parties we engage in order to provide our services, including contractors and service providers used for data processing, data analysis, customer satisfaction surveys, information technology services and support, website maintenance/development, printing, archiving and market research.

Personal information may also be shared between related and affiliated companies of the Group located in Australia and overseas

Third parties to whom we have disclosed your personal information may contact you directly to let you know that they have collected your personal information and to give you information about their privacy policies.

Any recipients of user data are compliant with Apple and iOS policies.

6.3       Use and disclosure for administration and management

Members of the Group will also use and disclose personal information for a range of administrative, management and operational purposes. This includes:

  • Administering billing, payments and debt recovery;
  • Planning, managing, monitoring and evaluating our services;
  • Quality improvement activities;
  • Statistical analysis and reporting;
  • Training staff, contractors and other workers;
  • Risk management and management of legal liabilities and claims (for example liaising with insurers and legal representatives;
  • Responding to enquiries and complaints regarding our services;
  • Obtaining advice from consultants and other professional advisors; and
  • Responding to subpoenas and other legal orders and obligations.

6.4       Other uses and disclosures

If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances.

By providing us with personal information, you consent to the terms of this Privacy Policy and the types of disclosure covered by this Policy. Where we disclose your personal information to third parties, we will request that the third party follow this Policy regarding handling your personal information.

We may use and disclose your personal information for other purposes explained at the time of collection as set out in the Privacy Policy.

The Group reserves the right to vary this Policy from time to time to improve the effectiveness of its operation.
